Effective Whistleblowers’ Protection: A ‘Must’ For Ensuring Your Organization’s Sustainability

ΠΕΡΙΓΡΑΦΗ
Wrongdoing, and in particular that which takes place in the corporate environment, is often committed in secret for a long time, during which time, non-involved employees happen to know what is going on.
Therefore, both the public and the private sector have a direct and vital interest in encouraging those who know about the wrongdoing (the unlawful/unethical act) to report it. At the same time, however, they have an obligation to provide complainants with adequate and effective protection.
EU Directive 2019/1937 on the protection of whistleblowers, which EU Member States should transpose into national law, obliges entities of public and private legal nature to offer adequate and effective protection of whistleblowers.
However, both the transposition of the Directive and its implementation in the corporate environment raise challenges which need to be managed by the competent national authorities and corporate professionals, respectively.
Professionals need to have a strong understanding of the concept of whistleblowing, relevant international best/benchmark practices in the public and private sectors, as well as the legal, organisational and technical requirements for the effective protection of whistleblowers in the working environment.

Upon completion of the seminar, participants will have attained a comprehensive understanding of the whistleblowing concept and will be able to:
- Evaluate how the Directive can be best transposed into national law
- Describe the deficiencies of the Directive which could be ameliorated by national law
- Identify what elements an adequate and effective whistleblowing programme should have
- Explain how a whistleblowing programme should be communicated within the working environment
- Provide education and training within the working environment
- Promote compliance with the whistleblowing programme within the working environment
- Identify the risks connected with whistleblowing

Industry Expert | Anna Damaskou
Dr Anna Damaskou has been the Chair of the Board of Transparency International-Greece since October 2017. Before that, she was a long-standing researcher for Transparency International, while she has been publishing extensively in the fields of good governance and anti-corruption. Before joining the Compliance Department of the Black Sea Trade & Development Bank, where she is currently employed, Dr Damaskou worked for the Greek & Cypriot Desk of the European Central Bank Legal Service, the Hellenic Ministry of Development, the Hellenic Capital Market Commission, as well as the Compliance Department of the National Bank of Greece. Dr Damaskou has carried out post-doctoral research in the University of Luxembourg in the fields of EU financial criminal law and EU Banking Union law, while she holds a PhD degree from the Queen Mary University of London on the criminal protection of the EU financial interests, as well as an LL.M degree from the London School of Economics & Political Science focusing on banking and financial law.
Training Style
The seminar is designed to deliver knowledge and enhance participants’ skills via lectures, case-studies, practical examples, real-life simulations, group-discussion and peer-sharing experience.
